GENERAL TERMS AND CONDITIONS OF SALE
Article 1
This contract is granted to tenants for tourist purposes and is seasonal in nature.
Article 2
Length of stay The tenant, signatory of this contract, which is for a fixed term, may not, under any circumstances, claim any right to remain on the premises after the end of the term. Furthermore, the rental agreement concluded between the parties may not, under any circumstances, benefit third parties, whether natural or legal persons, without the written consent of the owner.
Article 3
Conclusion of the contract : The reservation becomes final only upon receipt of a 30% deposit, collected upon receipt and deductible from the invoice and a signed copy of the contract.
Paying a deposit signifies acceptance of the general terms and conditions of sale.
The balance is payable on site either: in cash, by check 15 days before arrival, or by bank transfer 48 hours before arrival. (Request bank details.)
A second copy of the contract should be kept by the tenant.
Article 4
Cancellation by the tenant : All cancellations must be notified to the owner by registered letter.
a) Cancellation up to 15 (fifteen) days before your arrival: refund of the deposit less a 10% booking fee
b) Cancellation 8 (eight) days before the scheduled arrival date: the deposit remains with the owner. The owner may claim the balance of the stay if the property has not been re-let.
c) If the tenant does not arrive within 24 hours of the scheduled arrival date indicated on the contract, this contract becomes void and the owner may make the property available to other parties. The deposit also remains with the owner, who will request the balance of the rental.
d) If the tenant shortens the stay, the rental price remains due to the owner. No refund or rent reduction will be issued.
Article 5
Cancellation by the owner : If the owner cancels the stay, they must inform the client before the start of the stay. The client will be immediately refunded by bank transfer for their deposit already paid.
Article 6
Arrival/Departure : Arrival and departure times are specified in your rental agreement. The tenant must arrive on the date and at the time indicated on their agreement. In case of late or delayed arrival, the tenant must notify us by telephone at 06 35 25 50 04. On the day of departure, we ask that you respect the agreed-upon time for the smooth running of the next tenants.
Article 7
Condition report : An inventory is drawn up jointly and signed by the tenant and the owner or their representative, upon the tenant's arrival and departure.
The cleanliness of the cottage upon the tenant's arrival must be noted in the inventory. Cleaning the premises is the tenant's responsibility during the rental period.
Article 8
Disputes : All complaints relating to the condition of the premises and the accuracy of the property description upon arrival must be submitted to the owner within 48 hours of arrival.
Article 9
Security deposit : Upon arrival of the tenant, a security deposit of five hundred euros is required.
( €500) is requested by the owner. After the joint establishment of the exit inventory and the verification of the good condition and proper functioning of the various remote controls, this deposit is returned.
In the event of damage, the security deposit will be retained to allow the owner to repair the damage. The remaining balance will be returned no later than 15 days after deduction of the repair costs, upon presentation of the invoice.
In the event of early departure, prior to the time indicated on the property description, preventing the completion of the inventory and inspection of the property on the day of the tenant's departure, the security deposit will be returned by the owner within 15 working days, less the cost of any necessary repairs if damage is found, with supporting documentation.
Article 10
Use of the premises : The tenant must ensure the peaceful enjoyment of the rental property and use it in accordance with its intended purpose. After 10 p.m., they must respect the peace and quiet of Mas Joyeux's guests and the neighborhood.
All indoor spaces are non-smoking, in accordance with French law.
Eating is prohibited in the rooms.
Article 11
Capacity : This contract is established for a maximum number of people. Should this number be exceeded, the owner reserves the right to refuse entry to the additional clients or to add a surcharge to the price.
Article 12
Insurance : The tenant is responsible for all damages caused by them, their companions, or any visitors. A holiday rental insurance certificate will be required (check with your insurance company).
Article 13
Visitors :The tenant may not invite visitors to the cottage without the prior permission of the owner.
Article 14
Wi-Fi is free for the duration of your stay. Downloading content from paid or free websites is strictly prohibited . For paid websites, the bill will be presented to the tenant. An addendum entitled "Use of Wi-Fi," which establishes the tenant(s)' legal liability for what they have viewed and/or for any violation of Article 15, must be signed by the tenant(s). This addendum is attached to the rental agreement on page 6. It is the tenant(s)' responsibility to inform any accompanying persons or visitors during their stay of the existence of Article 15 and the associated liabilities.
Article 15
The Swimming Pool : Safety standards are shared and stipulated in the cottage booking contract; the tenant(s) agree to comply with them in full. The owner declines all responsibility in the event of non-compliance with the safety measures that the tenant will have signed in the rental contract. Article 17
Article 16
House rules explaining how a rental at Mas Joyeux works are posted in the cottage, along with rules for the use of the swimming pool area, which reiterate Article 15 above.
Article 17
Monthly rental : Monthly rental is possible under certain conditions and at a preferential rate.
Article 18
Animals : Our animal friends are not allowed, except for assistance animals and upon request.
Article 19
Forgotten itemAny forgotten item can be returned to its owner, subject to prior payment of shipping costs.
Article 20
Individual Police Form : In France, a police form is mandatory and must be completed for foreign clients.
Article 21
Changes to the Terms and Conditions : These General Terms and Conditions of Sale may be changed at any time without prior notice. The General Terms and Conditions are deemed accepted upon payment of the deposit for the rental of the cottage.
